THE PEOPLE OF THE STATE OF NEW YORK, RESPONDENT, v. JESSIE J. BARNES, DEFENDANT-APPELLANT.


PRESENT:

Appellant having moved for an extension of time to file and serve a pro se supplemental brief on the appeal taken from a judgment of the Monroe County Court, rendered August 31, 2009, and having moved for an order waiving his right to file a pro se supplemental brief,

Now upon reading and filing the affidavits of Jessie J. Barnes sworn to July 12, 2017 and July 18, 2017, the notices of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion for an extension is dismissed, and

It is further ORDERED that the motion seeking an order waiving his right to file a pro se supplemental brief is dismissed as unnecessary.
