PEOPLE v. BANG

Appellate Term of the Supreme Court of New York, Second Department
Jun 29, 2010
2010 N.Y. Slip Op. 51173 (N.Y. App. Term 2010)

Opinion

2009-701 RO CR.

Decided June 29, 2010.

Appeal from a judgment of the Justice Court of the Town of Ramapo, Rockland County (Samuel Coleman, J.), rendered April 1, 2009. The judgment convicted defendant, after a nonjury trial, of speeding.

ORDERED that the judgment of conviction is affirmed.

PRESENT: NICOLAI, P.J., LaCAVA and IANNACCI, JJ.

Upon a review of the record, we are of the opinion that the evidence, when viewed in the light most favorable to the prosecution ( see People v Contes, 60 NY2d 620), was legally sufficient to establish all of the elements of speeding (Vehicle and Traffic Law § 1180 [d]) beyond a reasonable doubt ( see People v Dusing, 5 NY2d 126). We have reviewed defendant's remaining contentions and find them to be without merit.

Accordingly, the judgment convicting defendant of speeding is affirmed.

Nicolai, P.J., LaCava and Iannacci, JJ., concur.
