DECISION & ORDER ON MOTION

Motion by the appellant on an appeal from an order of protection of the Supreme Court, Kings County, dated April 2, 2012, inter alia, to vacate and set aside the order of protection.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that on the Court's own motion, the appeal is dismissed, on the ground that the order of protection is not appealable as of right or by permission (see CPL 450.15 and 460.15); and it is further,

ORDERED that the motion is denied as academic.
