DENYING R EHEARING

THE COURT:
It is ordered that the opinion filed herein on September 27, 2012, be modified as follows:
On page 5, the following paragraph is inserted following the third full paragraph beginning "The trial court":
The trial court also expressly found that Baker was not a suitable candidate for outpatient treatment pursuant to section 2972, subdivision (d). Specifically, the trial court noted that Baker testified her prescribed medication did not help her. The trial court then stated, apparently relying on Potts's testimony, that Baker likely would cease taking her medication if released and thereby lapse into paranoid psychotic delusions. The trial court also found that Baker had no wellness plan and no family support. These factors, according to Potts, would lead to Baker causing harm to others.
There is no change in the judgment.
Appellant's petition for rehearing is denied.
