PEOPLE of the State of Michigan, Plaintiff-Appellee, v. Jeffrey Lloyd BADER, Defendant-Appellant.


Order

On order of the Court, the application for leave to appeal the September 28, 2021 order of the Court of Appeals is considered and, pursuant to MCR 7.305(H)(1), in lieu of granting leave to appeal, we REMAND this case to the Court of Appeals for reconsideration of the defendant's challenges to his bindover under MCR 7.205 in light of the concern articulated in People v. Yost , 468 Mich. 122, 124 n. 2, 659 N.W.2d 604 (2003). In all other respects, leave to appeal is DENIED, because we are not persuaded that the remaining question presented should be reviewed by this Court.

We do not retain jurisdiction.
