Motion to dismiss the cross appeal taken by defendant herein granted and the cross appeal dismissed upon the ground that no appeal lies to this court without a certificate (Code Crim. Pro., § 520).

Cross motion by defendant for leave to appeal denied, without prejudice to a petition to the clerk of the court to have his papers treated as an application for a certificate upon proof that they were timely filed (Code Crim. Pro., §§ 520, 521).
