Opinion

THE PEOPLE, Plaintiff and Respondent, v. KELLY LEWIS BABER, Defendant and Appellant. E040189 California Court of Appeal, Fourth District, Second Division June 20, 2007

Super.Ct.No. RIF 125678

ORDER DENYING PETITION FOR REHEARING AND MODIFYING OPINION

RICHLI, J.

Appellant’s petition for rehearing is denied. The opinion filed in this matter on June 6, 2007, is modified as follows:

In the first sentence of the first paragraph on page two, the words “teenaged girls” are replaced by the word “teenagers” so that the sentence reads:

Defendant, while intoxicated, rammed his pickup truck four times into the back of a car occupied by two teenagers.

Except for this modification, the opinion remains unchanged. This modification does not effect a change in the judgment.

We concur: RAMIREZ, P.J. McKINSTER, J.
