ORDER MODIFYING OPINION AND DENIAL OF PETITION FOR REHEARING; NO CHANGE IN JUDGMENT

It is ordered that the opinion filed herein on June 20, 2003, be modified as follows:

On page 5, add the following sentence at the end of the first full paragraph: "This is so despite the Peoples characterization of a section 4573.8 violation as involving `dangerous conduct beyond the mere possession or use of drugs."

This modification does not effect a change in the judgment. The petition for rehearing is DENIED.
