THE PEOPLE, Plaintiff and Respondent, v. DWAYNE AUSTIN, Defendant and Appellant.

Jean Ballantine, under appointment by the Court of Appeal, for Defendant and Appellant. No appearance for Plaintiff and Respondent.

A jury convicted Dwayne Austin (defendant) of arson (Pen. Code, § 451, subd. (c)), use of threats or violence on a police officer (Pen. Code, § 69), violating a protective order (Pen. Code, § 273.6, subd. (a)), and two counts each of assault on a police officer by means of force likely to produce great bodily injury (Pen. Code, § 245, subd. (c)) and assault on a police dog (Pen. Code, § 600, subd. (a)). He was sentenced to prison for six years.

Defendant appealed and upon his request, this court appointed counsel to represent him. Counsel has filed a brief under the authority of People v. Wende (1979) 25 Cal.3d 436 and Anders v. California (1967) 386 U.S. 738 [87 S.Ct. 1396, 18 L.Ed.2d 493], setting forth a statement of the case, a summary of the facts, and requesting this court to undertake a review of the entire record.

We offered defendant an opportunity to file a personal supplemental brief, which he has not done.

We have now concluded our independent review of the record and find no arguable issues.

DISPOSITION

The trial court is directed to amend the second amended abstract of judgment to delete the word, "nondwelling," in the description of count 1 and substitute in its place the word, "structure." In all other respects, the judgment is affirmed.

We concur: McKINSTER, J., RICHLI, J.
