THE PEOPLE OF THE STATE OF NEW YORK, Respondent, v. CODY J. AUSTIN, Appellant.

DECISION AND ORDER ON MOTION

By order dated May 4, 2017, assigned counsel, A. Renee Sutton, Esq., was granted an extension of time to perfect this appeal until July 3, 2017. The order noted that no further extensions would be granted absent an unanticipated excuse for the delay. Counsel has failed to perfect the appeal or seek a further extension of time to do so.

Now, therefore, upon the Court's own motion, it is

ORDERED that in the event the appeal is not perfected on or before September 11, 2017, A. Renee Sutton, Esq., shall be relieved of this assignment and new counsel assigned.

Peters, P.J., McCarthy, Devine and Clark, JJ., concur.
