Appellate Division of the Supreme Court of New York, Second Department
May 6, 2008
51 A.D.3d 682 (N.Y. App. Div. 2008)

Opinion

No. 2005-09555.

May 6, 2008.

Appeal by the defendant from a judgment of the Supreme Court, Suffolk County (Farneti, J.), rendered September 7, 2005, convicting him of aggravated criminal contempt, upon his plea of guilty, and imposing sentence.

Robert C. Mitchell, Riverhead, N.Y. (Alfred J. Cicale of counsel), for appellant, and appellant pro se.

Thomas J. Spota, District Attorney, Riverhead, N.Y. (Steven A. Hovani and Guy Arcidiacono of counsel), for respondent.

Before: Skelos, J.P., Santucci, Covello, McCarthy and Chambers, JJ.

Ordered that the judgment is affirmed.

We have reviewed the record and agree with the defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted ( see Anders v California, 386 US 738; People v Paige, 54 AD2d 631; cf. People v Gonzalez, 47 NY2d 606).

The defendant has not, nor could he have, raised any nonfrivolous issues in his supplemental pro se brief.
