People v. Arter

Court of Appeal of California, First District, Division Two
May 31, 1928
92 Cal.App. 328 (Cal. Ct. App. 1928)

Opinion

Docket No. 1465.

May 31, 1928.

APPEAL from a judgment of the Superior Court of the City and County of San Francisco, and from an order denying a new trial. Harold Louderback, Judge. Affirmed.

The facts are stated in the opinion of the court.

U.S. Webb, Attorney-General, and Lionel Browne, Deputy Attorney-General, for Respondent.

THE COURT.

The defendant and Bert Palmer were jointly charged with the crime of grand theft. They were tried before a jury and both convicted, but the trial court granted Palmer a new trial. [1] The defendant has appealed from the judgment following his conviction and from the order denying him a new trial, but has not supported his appeal by either brief or oral argument. We have, nevertheless, examined the record and are satisfied that he was fairly tried and convicted.

Judgment and order affirmed.
