People v. Archeval

Appellate Division of the Supreme Court of New York, Second Department
Nov 23, 1998
255 A.D.2d 518 (N.Y. App. Div. 1998)

Opinion

November 23, 1998

Appeal from the Supreme Court, Kings County (Marrus, J.).

Ordered that the judgment is affirmed, and the matter is remitted to the Supreme Court, Kings County, for further proceedings pursuant to CPL 460.50.

The search warrant and supporting affidavit at issue sufficiently described the area to be searched ( see, People v. Nieves, 36 N.Y.2d 396, 401; People v. Graham, 220 A.D.2d 769, 771), and the warrant was not overbroad ( see, People v. Bogdan, 59 A.D.2d 1026).

The defendant's remaining contentions are without merit ( see, People v. Anderson, 190 A.D.2d 741; People v. Bouzy, 242 A.D.2d 729).

Copertino, J. P., Sullivan, Pizzuto and Goldstein, JJ., concur.
