ORDER

Douglas B. Shapiro, Judge, acting under MCR 7.211(E)(2), orders:

Defendant-appellant's pro se application for leave to appeal to the Supreme Court resulted in a Supreme Court order remanding this matter to this Court for consideration as on leave granted. Defendant-appellant did not have appointed counsel in this Court when he filed his application for leave to appeal; and, therefore, the matter is REMANDED to the trial court for the appointment of an attorney to represent defendant-appellant for this appeal. MCR 7.208(H).

The trial court shall appoint counsel for defendant-appellant within 21 days of the Clerk's certification of this order unless defendant-appellant notifies both the trial court and this Court, within the 21-day period, that he does not wish to be represented by appointed counsel. If defendant-appellant does not notify the trial court and this Court in accordance with this order and the trial court thereafter appoints counsel, the trial court shall send a copy of the order naming appointed counsel to the Clerk of this Court within 7 days of entry of the order.

This Court retains jurisdiction.
