DECISION & ORDER ON MOTION

Appeal from a judgment of the Supreme Court, Suffolk County, rendered March 20, 2018. Motion by the appellant's assigned counsel, in effect, to withdraw the appeal on the ground that it has been rendered academic. By order to show cause dated October 13, 2021, the parties to the appeal were directed to show cause before this Court why the appeal should or should not be dismissed on the ground that it has been rendered academic, and assigned counsel's motion was held in abeyance in the interim.

Now, upon the order to show cause and no papers have been filed in response thereto, and upon the papers filed in support of assigned counsel's motion and the papers filed in relation thereto, it is

ORDERED that the motion by this Court to dismiss the appeal is granted, and the appeal is dismissed, without costs or disbursements; and it is further, ORDERED that the motion by assigned counsel is denied as academic.
