DECISION AND ORDER ON MOTION

Motion to compel compliance and for appointment of special district attorney.

Upon the papers filed in support of the motion, and no papers having been filed in opposition thereto, it is

ORDERED that the motion to compel compliance is denied, and it is further

ORDERED that the motion for appointment of a special district attorney is denied without prejudice to a motion for such relief being made in a superior criminal court in Albany County (see County Law § 701 [1]).
