DECISION & ORDER ON MOTION
Motion by respondent for leave to reargue an appeal from an order of the Criminal Court of the City of New York, Queens County, dated June 4, 2021, which was determined by decision and order of this court dated August 4, 2023.
Erroneously described in the appeal decision and order as having been entered June 8, 2021.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted and, upon reargument, the decision and order of this court dated August 4, 2023 (80 Misc.3d 127[A], 2023 NY Slip Op 50887[U]) is recalled and vacated, and a new decision and order substituted therefor (see appeal No. 2021-421 Q CR, decided simultaneously herewith).
