DECISION & ORDER ON APPLICATION

Application by the respondent on an appeal from an order of the County Court, Orange County, dated October 30, 2009, to enlarge its time to comply with a decision and order on motion of this Court dated August 9, 2011, which directed it to either remove any references to certain proceedings which occurred on January 23, 2006, from the brief on file with this Court, or serve and file a replacement brief that did not contain any references to the January 23, 2006, proceedings.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the application is granted and the respondent's time to comply with the decision and order on motion of this Court dated August 9, 2011, is enlarged until September 7, 2011.
