MOTION DECISION

Defendant having previously moved for a writ of error coram nobis on the ground that his trial counsel was ineffective in failing to file a timely notice of appeal from a judgment of the Supreme Court, New York County, rendered on or about May 03, 2017, and for related relief (M-2022-00511), And defendant-appellant, pro se, having moved to file an addendum to the aforementioned motion for coram nobis relief (M-2022-01648), Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is denied as academic, an order of this Court having been entered on March 24, 2022 (M-2022-00511) granting defendant-appellant's motion for relief in the nature of a writ of error coram nobis to the extent of deeming defendant's motion papers a timely filed notice of appeal from the aforesaid judgment rendered on or about May 3, 2017, and denying defendant's request for poor person relief, with leave to renew upon submission of proper papers.
