OFFICERS AND PUBLIC EMPLOYEES, § 68affirmance of denial of mandamus to compel restoration to office. Denial of writ of mandamus, sought by petitioner to compel his restoration to police force on ground that Civil Service Commission, which tried and found him guilty of intoxication while on duty, was illegally constituted, would be affirmed, where evidence disclosed that such commission was not illegally constituted (Ill. Rev. Stat. 1941, ch. 24 1/2, par. 39; Jones Ill. Stats. Ann. 23.040).

Appeal from the Circuit Court of Cook county; the Hon. GEORGE W. BRISTOW, Judge, presiding.

Judgment affirmed. Heard in the first division, first district, this court at the October term, 1942.
