Present — Taylor, P.J., McCurn, Love, Vaughan and Piper, JJ.


Judgment of conviction and order affirmed. All concur, except Taylor, P.J., who dissents and votes for reversal and for granting a new trial on the ground that the verdict is against the weight of evidence. (The judgment convicts defendant of the crime of manslaughter, first degree, with a recommendation of leniency. The order denies a motion for a new trial.)
