The motion for immediate consideration is GRANTED.

The application for leave to appeal is DENIED for failure to persuade the Court of the need for immediate appellate review.

The motion to waive the transcript and order production requirements of MCR 7.209 is GRANTED.

The motion for stay pending appeal is DENIED.

The motion to waive fees is DENIED AS MOOT, the necessary fees having been paid.

On its own motion pursuant to MCR 7.216(C), this Court ASSESSES sanctions. The Court determines that the application filed on behalf of defendant is "grossly lacking in the requirements of propriety" and "grossly disregarded the requirements of a fair presentation of the issues to the court." MCR 7.216(C)(1)(b). Specifically, the brief filed in support of the application grossly misrepresents the trial court's conduct at the September 9, 2021 hearing. Attorney Mark A. Linton (P66503) is ordered to pay the Clerk of this Court $250.00 within 28 days of the date of this order. The costs assessed are personal to the attorney and may not be charged back to the client.
