THE PEOPLE, Plaintiff and Respondent, v. MANUEL ALFARO, Defendant and Appellant.

NOT TO BE PUBLISHED IN OFFICIAL REPORTS

California Rules of Court, rule 8.1115(a), prohibits courts and parties from citing or relying on opinions not certified for publication or ordered published, except as specified by rule 8.1115(b). This opinion has not been certified for publication or ordered published for purposes of rule 8.1115.

Santa Cruz County Super. Ct. No. F19528

In November 2010, defendant Manuel Alfaro was charged with possession for sale of methamphetamine (Health & Saf. Code, § 11378), transportation of methamphetamine (Health & Saf. Code, § 11379, subd. (a)), and possession of Oxycodone (Health & Saf. Code, § 11350, subd. (a)).

In March 2011, the trial court advised defendant of his constitutional rights to a jury trial, to present a defense, to confrontation, and to self-incrimination. Defendant waived these rights and pleaded no contest to all three charges. In exchange for his plea, defendant was promised that he would be placed on probation with a one-year county jail sentence. Counsel stipulated that there was a factual basis for the plea as set forth in the police report. The trial court immediately proceeded to sentencing and placed defendant on probation for three years with various terms and conditions, including a one-year county jail sentence.

The record on appeal does not contain any recitation of the underlying facts.

Defendant filed a timely notice of appeal.

Appointed appellate counsel has filed an opening brief which states the case and the facts but raises no issues. Defendant was notified of his right to submit written argument on his own behalf but he has failed to avail himself of the opportunity. Pursuant to People v. Wende (1979) 25 Cal.3d 436, we have reviewed the entire record and have concluded that there are no arguable issues on appeal.

The judgment is affirmed.

Mihara, J. WE CONCUR: Bamattre-Manoukian, Acting P. J. Walsh, J.

Judge of the Santa Clara County Superior Court, assigned by the Chief Justice pursuant to article VI, section 6 of the California Constitution.
