Opinion

F042222.

11-5-2003

THE PEOPLE, Plaintiff and Respondent, v. ARLENE AGUILAR, Defendant and Appellant.

John Steinberg, under appointment by the Court of Appeal, for Defendant and Appellant. Bill Lockyer, Attorney General, Robert R. Anderson, Chief Assistant Attorney General, Jo Graves, Assistant Attorney General, and Carlos A. Martinez, Deputy Attorney General, for Plaintiff and Respondent.

OPINION

Appellant Arlene Aguilar was convicted on October 31, 2000, of multiple felonies and misdemeanor false imprisonment (Pen. Code, § 237, subd. (a)). In case No. F037436, this court found the trial court erroneously sentenced Aguilar for felony false imprisonment. We vacated Aguilars sentence for false imprisonment and remanded to the trial court for resentencing on that count. In all other respects, Aguilars judgment was affirmed.

At resentencing, the trial court found the false imprisonment conviction was a misdemeanor and sentenced Aguilar to a concurrent one-year term. The abstract of judgment was corrected.

Aguilars appointed appellate counsel has filed an opening brief which summarizes the pertinent facts, raises no issues, and requests this court independently to review the record. (People v. Wende (1979) 25 Cal.3d 436.) The opening brief also includes the declaration of appellate counsel indicating that Aguilar was advised she could file her own brief with this court. By letter of June 16, 2003, we invited Aguilar to submit additional briefing. To date, she has not done so.

After independent review of the record, we have concluded no reasonably arguable legal or factual argument exists.

The judgment is affirmed.
