Motion for access to sealed record granted

Respondent's “Motion for Access to Sealed Penal Code Section 987.9 Materials Filed in Case Number [S149039] for use in the Pending State Habeas Proceedings,” filed on April 6, 2017, is granted. The Clerk is directed to provide respondent access to the materials filed under seal in the above-entitled record on appeal pursuant to Penal Code section 987.9: “Comprehensive Index of Confidential P.C. 987.9 Documents as of 01/22/08”; “Confidential P.C. 987 Documents,” Volume 9, pages 2401-2700; “Confidential Penal Code 987.9 Transcript,” Volume 28, pages 8101-8400, and Volume 30, pages 8701-9000; and “Reporter's Transcript of [2/26/04] 987.9 Hearing,” pages 1-9. The Attorney General must supply the personnel and equipment necessary to undertake the examination and copying of these documents, which must occur on the premises of the court. Except as provided herein, these documents remain under seal and their use must be limited solely to the pending proceedings. (Pen. Code § 987.9, subd. (d).)
