Motion granted to the extent of dismissing the appeal due to the death of the appellant on October 26, 1972, and remanding the case to the Supreme Court, Bronx County, to vacate the judgment of conviction and to dismiss the indictment ( People v. Mintz, 20 N.Y.2d 753).
