An appeal having been taken from a judgment of the Supreme Court, New York County, rendered on or about April 2, 2015, And, an order of this Court having been entered on September 15, 2015 (M-3760), granting defendant poor person relief and assigning Richard M. Greenberg, Esq., Office of the Appellate Defender, as now succeeded by Rosemary Herbert, Esq., And, defendant having moved for an order relieving assigned counsel and substituting new counsel to prosecute the appeal, Now, upon reading and filing the papers with respect to the motion, and the correspondence submitted by successor assigned counsel, Rosemary Herbert, Esq., and due deliberation having been had thereon, it is Ordered that the motion to relieve counsel is deemed withdrawn.
