ORDER

The motion for immediate consideration is GRANTED.

The motion to waive the requirements of MCR 7.209 is GRANTED.

The application for leave to appeal is GRANTED. The time for taking further steps in this appeal runs from the date of the Clerk's certification of this order. MCR 7.205(E)(3). This appeal is limited to the issues raised in the application and supporting brief. MCR 7.205(E)(4).

On the Court's own motion, defendant is to be immediately released on personal recognizance bond pending appeal. Defendant satisfies the criteria for release pending appeal. See People v Giacalone, 16 Mich.App. 352, 354; 167 N.W.2d 871 (1969). Defendant shall be admitted to bail pending resolution of this appeal or further order of this Court, and the district court shall effectuate defendant's immediate release.

The motion for stay is GRANTED, and further proceedings are STAYED pending resolution of this appeal or further order of this Court.

This order is to have immediate effect, MCR 7.215(F)(2).
