People ex Rel. Valerie Realty, Inc. v. Briggs

Appellate Division of the Supreme Court of New York, Second Department
Dec 22, 1942
265 App. Div. 961 (N.Y. App. Div. 1942)

Opinion

December 22, 1942.

In a certiorari proceeding to review the assessment on real property, order granting respondents' motion to compel appellants to serve and file a further return to the writ, modified on the law and the facts by striking from the second ordering paragraphs the words "include sworn copies of any" and by substituting in place thereof the words "incorporate by reference all." As thus modified, the order is affirmed, without costs, the return to be filed within twenty days from the entry of the order hereon. If the appellants considered and acted upon any papers, documents, etc., they should be identified in the return by date or other description. If there were no such documents, the return should so state. Lazansky, P.J., Carswell, Johnston, Adel and Taylor, JJ., concur.
