PEOPLE EX REL. STEARNS v. MARR

Appellate Division of the Supreme Court of New York, Fourth Department
Dec 1, 1903
89 App. Div. 617 (N.Y. App. Div. 1903)

Opinion

December, 1903.

Motion for leave to appeal to Court of Appeals denied upon the ground that the appeal to this court only presented a question of fact. All concurred, except Hiscock, J., who dissented upon the ground that defendants should be permitted to review in the Court of Appeals the question whether, as a matter of law, the facts appearing authorized the making of the orders in question.
