In a habeas corpus proceeding, relator appeals from a judgment of the County Court, Westchester County, entered September 24, 1970, which dismissed the writ. Appeal dismissed, in view of relator's release on bail on December 3, 1970 ( People ex rel. Wilder v. Markley, 26 N.Y.2d 648), without costs. Christ, P.J., Munder, Latham, Kleinfeld and Brennan, JJ., concur.
