Application pursuant to CPLR 7002 (subd [b], par 2) for writ of habeas corpus denied on the ground petitioner's double jeopardy contentions are without merit (see, e.g., Matter of Napoli v Supreme Ct. of State of N.Y., 40 A.D.2d 159, 161, affd 33 N.Y.2d 980, cert den 417 U.S. 947). Sweeney, J.P., Staley, Jr., Main, Mikoll and Herlihy, JJ., concur.
