For the reasons stated in the case of The People ex rel. Grady v. Knox, decided herewith ( ante, p. 334), the order appealed from is reversed and motion denied, with costs. Van Brunt, P.J., and Patterson J., concurred; O'Brien, J., dissented.


For the reasons stated in my opinion in The People ex rel. Grady v. Knox, decided herewith, I concur with Mr. Justice Ingraham.
