People ex Rel. Horowitz v. Morhous

Appellate Division of the Supreme Court of New York, Third Department
May 4, 1949
275 App. Div. 868 (N.Y. App. Div. 1949)

Opinion

May 4, 1949.

Appeal from Supreme Court, Washington County.

Present — Foster, P.J., Heffernan, Brewster, Deyo and Bergan, JJ.

Relator pleaded guilty to the crime of robbery, second degree. He asserts that such conviction should be set aside on the grounds that he was arrested in his home by an officer without a warrant, and that the premises were searched by officers without a search warrant. These acts, he claims, were in violation of his constitutional rights, both State and Federal, and require that his conviction should be set aside. The order should be affirmed. Order unanimously affirmed.
