Proceedings annulled and relator reinstated, with fifty dollars costs and disbursements. —


The questions in this case are the same as those in People ex rel v. Kiebrick v. The Same Defendants (see, ante, 577), and the result must be the same as was reached there. The proceedings had should be annulled, and the relator reinstated, with fifty dollars costs and disbursements. Van Brunt, P.J., Rumsey, Williams and Patterson, JJ., concurred.
