Gen. No. 41,339. (Abstract of Decision.)
Opinion filed April 23, 1941
OFFICERS AND PUBLIC EMPLOYEES, § 67.1 — removal of park district chauffeur, propriety. In mandamus proceeding against park district which removed plaintiff from his civil service position as a chauffeur because he had the sight of only one eye, court had no right to inquire into the discretion exercised by the civil service board provided it acted within its statutory powers, record showed all necessary jurisdictional facts on its face, secretary of the civil service board filed charges in his official capacity and did not prejudge the case which he subsequently heard as a member of the board, evidence did not show that investigating officer was disqualified, and trial court erred in compelling production of transcript of the testimony taken at the hearing before the board.
