Application for permission to proceed as a poor person and assignment of counsel denied on the ground that the order appealed from, which denied reargument of a judgment denying appellant's application for a writ of habeas corpus, is not appealable. (See CPLR 7011; Matter of Rzepecka, 284 App. Div. 867.) Gibson, P.J., Herlihy, Reynolds, Aulisi and Staley, Jr., JJ., concur.
