People ex Rel. Griffin v. Warden

Appellate Division of the Supreme Court of New York, Second Department
Nov 20, 1972
40 A.D.2d 859 (N.Y. App. Div. 1972)

Opinion

November 20, 1972

In a habeas corpus proceeding, relator appeals, as limited by his brief, from so much of a judgment of the Supreme Court, Kings County, entered February 5, 1971, as denied the application for a writ. Appeal dismissed, without costs. The application for the writ was based, inter alia, on excessive bail. This issue is moot in light of relator's subsequent plea of guilty, at which time he withdrew all motions and appeals. Latham, Acting P.J., Shapiro, Gulotta, Christ and Brennan, JJ., concur.
