ORDER MODIFYING OPINION AND CERTIFYING OPINION FOR FULL PUBLICATION (NO CHANGE IN JUDGMENT)

THE COURT:

The opinion of this court filed March 16, 2007, in the above entitled case is modified as follows:

1. On line 2 of page 3, insert the word “former” between the words “defendants’” and “attorney” so that the phrase reads “the county defendants’ former attorney.”

2. On page 38, in the last sentence of the first paragraph, insert the word “former” between the words “their” and “attorney” so that the phrase reads “their former attorney.”

This modification does not affect the judgment.

The opinion in the above-entitled matter filed March 16, 2007, was certified for partial publication in the Official Reports. For good cause it now appears the opinion should published in its entirety in the Official Reports and it is so ordered. The last sentence in the second full paragraph which reads “In the unpublished portion of the opinion, we disagree and will therefore affirm the judgment” should be deleted.
