Appeal from Clinton County Court.

Present — Heffernan, J.P., Brewster, Deyo, Santry and Bergan, JJ.


The relator by his own confession was convicted of the crime of attempted burglary third degree at a term of Queens County Court held on the 7th day of April, 1947, and sentenced under an indeterminate sentence the maximum of such imprisonment to be five years and the minimum two and one-half years. Relator complains that the parole board has not treated him fairly and that the County Court failed to assign counsel on the hearing of the habeas corpus proceeding. The parole board is not a party to this proceeding. Order of the County Court unanimously affirmed.
