ORDER


After making an independent review of the pleadings, files and records in this case, and the findings, conclusions and recommendation of the United States Magistrate Judge filed on April 19, 2001, the court concludes that the findings and conclusions of the United States Magistrate Judge are correct. Petitioner filed no objections. The findings, conclusions and recommendation of the United States Magistrate Judge are hereby adopted by the court. This action is therefore dismissed with prejudice for failure to state a cognizable claim.

It is so ordered.
