OPINION AND DECISION AFTER RECONSIDERATION

We previously granted reconsideration in order to allow us time to further study the factual and legal issues in this case. We now issue our Opinion and Decision After Reconsideration.
We have considered the allegations of the Petition for Reconsideration. Based on our review of the record, and based on the correspondence by the parties regarding the need for MSA approval, we will rescind the February 18, 2021 Order Approving Compromise and Release and return this matter to the WCJ for further proceedings as determined appropriate by the WCJ and a new decision. This is not a final decision on the merits of any issues raised in the petition and any aggrieved person may timely seek reconsideration of the WCJ’s new decision.
For the foregoing reasons,
IT IS ORDERED as the Decision After Reconsideration of the Workers’ Compensation Appeals Board, that the February 18, 2021 Order Approving Compromise and Release is RESCINDED, and that this matter is RETURNED to the trial level for further proceedings and decision by the WCJ consistent with this opinion.
