MEMORANDUM OPINION
A jury found Christopher James Pennington guilty of indecency with a child by sexual contact. Pennington was sentenced to ten years' imprisonment and was ordered to pay a $2,500.00 fine. Pennington appeals.
In companion cause number 06-17-00031-CR, Pennington also appealed another conviction for indecency with a child. Pennington has field a single brief, in which he raises issues common to each of his appeals. Specifically, Pennington argues (1) that admission of a videotaped interview with the child was improper and (2) that the trial court erred in failing to grant Pennington a mistrial after the State elicited testimony, during the guilt/innocence phase, that Pennington violated bond conditions by smoking marihuana.
We addressed these issues in detail in our opinion of this date on Pennington's appeal in cause number 06-17-00031-CR. For the reasons stated therein, we likewise conclude that Pennington failed to preserve his first point of error for our review. We further find that a mistrial was not warranted.
Consequently, we affirm the trial court's judgment.
