TENA CAMPBELL, District Judge.

On April 18, 2003, Plaintiffs in this case filed their Partial Summary Judgment Motion re: 11^th Amendment Immunity. In a memorandum filed May 19, 2003, Utah consented to entry of partial summary judgement "that Utah has voluntarily and knowingly waived any and all immunity available under the 11^th Amendment to the United States Constitution." Accordingly, the court enters partial summary judgment on the Eleventh Amendment issue as set forth in Utah's May 19, 2003 memorandum.
