ORDER


On April 18, 2003, Plaintiffs in this case filed their Partial Summary Judgment Motion re: 11th Amendment Immunity. In a memorandum filed May 19, 2003, Utah consented to entry of partial summary judgement "that Utah has voluntarily and knowingly waived any and all immunity available under the 11th Amendment to the United States Constitution." Accordingly, the court enters partial summary judgment on the Eleventh Amendment issue as set forth in Utah's May 19, 2003 memorandum.

SO ORDERED.
