ORDER
On September 25, 2012, the plaintiff in a timely manner complied with the court's order of September 21, 2012, and filed proof of service on the State of Nevada in compliance with Nev. Rev. Stat. § 41.031. Accordingly, the court's order to show cause issued on October 29, 2012, is hereby VACATED and expunged as improvidently entered. This matter will be set for trial on the plaintiff's remaining claim at a date and time convenient to the parties and the court.
