Opinion

M.P. No. 1672.

March 16, 1972.

Denial of a motion for summary judgment is interlocutory in nature and not finally dispositive of the case. Absent peculiar circumstances, it is not reviewable prior to final judgment. Balme v. Gold-Bro, Inc., 108 R.I. 930, 277 A.2d 134 (1971). 1 Kent, R.I. Civ. Prac., § 56.12. Motion of Rhode Island Sand Gravel Co., Inc. for leave to file petition for a writ of certiorari is therefore denied.

Gunning, LaFazia, Gnys Selya, Raymond A. LaFazia, Edward P. Sowa, Jr., for plaintiff-respondent.

Jordan, Hanson Curran, A. Lauriston Parks, for Rhode Island Sand Gravel Co., Inc., defendant-petitioner.
