Pellito v. Home Depot, Inc.

District Court of Appeal of Florida, Fourth District
Jun 17, 1992
600 So. 2d 43 (Fla. Dist. Ct. App. 1992)

Opinion

No. 91-1414.

June 17, 1992.

Appeal and cross appeal from the Circuit Court for Broward County; Paul M. Marko III, Judge.

Ellis S. Rubin and Eric J. Miller of Rubin, Rubin Rubin, P.A., Miami, for appellants-cross appellees.

Shelley H. Leinicke of Wicker, Smith, Tutan, O'Hara, McCoy, Graham Lane, P.A., Fort Lauderdale, for appellee-cross appellant.

AFFIRMED. Although the rulings of the trial court at trial and on the motion for new trial were not necessarily those which this panel may have made, we cannot conclude that the rulings constituted an abuse of judicial discretion or reversible error. Ford Motor Co. v. Kikis, 401 So.2d 1341 (Fla. 1981).

ANSTEAD, LETTS and GUNTHER, JJ., concur.
