THE COURT HAS ORDERED THAT:

The Report and Recommendation is adopted and approved. Defendant's motion to seal and for a protective order (Dkt. 25) is GRANTED IN PART and DENIED IN PART. Defendant's request for a protective order (Dkt. 25) is GRANTED and Defendant is not required to provide a copy of the document in question (Dkt. 26) to Plaintiff. The Clerk is instructed not to provide a copy of the document (Dkt. 26) to the Plaintiff electronically or through any other means. The remainder of Defendant's motion (Dkt. 25), seeking to seal the document from the public, is DENIED. Plaintiff's motion for summary judgment (Dkt. 20) is DENIED. Defendant's cross-motion for summary judgment (Dkt. 22) is GRANTED and this case is DISMISSED and closed.
