Order reversed, with ten dollars costs and disbursements, and matter remitted to the Special Term for further proceedings. Held, that in view of the demand for judgment contained in the complaint, respecting the custody of the children, and the provisions of section 1771 of the Code of Civil Procedure, the trial court was authorized to make provision for the support and maintenance of the children. Kruse, P.J., Lambert, Hubbs and Davis, JJ., concur; Clark, J., not sitting.
