Pecan Ranch Family Trust, et al., Petitioners v. Commissioner of Internal Revenue, Respondent

ORDER

Alina I. Marshall Judge.

On August 31, 2021, the parties filed a status report, attaching thereto a proposed pretrial scheduling order. That proposed pretrial scheduling order reflects a remote trial at a special session of the Court scheduled to commence on February 28, 2022. On October 29, 2021, petitioners filed a motion to amend the proposed pretrial scheduling order attached to the parties' August 31, 2021 joint status report (petitioners' motion), seeking to delay any trial in these consolidated cases until after May of 2022.. On November 16, 2021, respondent filed a response to petitioners' motion, outlining respondent's objections to that motion. In that response, respondent requests that, if a delay in any trial in these consolidated cases is granted, that the trial commence prior to May of 2022.

Cases of the following petitioners are consolidated for purposes of trial: Pecan Ranch Family Trust, docket No. 21716-18; Richard W. Bandler & Glenda W. Bandler a.k.a. Glenda W. Bradstock, docket No. 21882-18; and Richard W. Bandler, docket No. 21723-18.

The Court has neither directed that the parties to adhere to any pretrial scheduling order nor set a date for any trial in these consolidated cases to commence. Thus, the Court deems petitioners' motion moot.

Accordingly, it is

ORDERED that petitioners' motion to amend the proposed pretrial order attached to the parties' August 31, 2021 joint status report, filed October 29, 2021, is denied as moot. It is further

ORDERED that, on or before January 12, 2022, the parties shall file either a joint or separate status report reflecting the then-present status of these consolidated cases, including the status of any matters pending before respondent's Independent Office of Appeals. Such report shall further advise the Court of the parties' respective availability for any trial in these consolidated cases in April, May, June, or July of 2022.
